RULES AND REGULATIONS
1. The condominium units at La Arboleda Village C.A. are to be
used only for residential purposes as a single family residence only.
2. Owners and Occupants shall not use or permit the use of
their unit in a manner which would be disturbing or a nuisance to other
occupants, or in a way as to be injurious to the reputation of the complex.
SALES / LEASES / LOANS OF UNITS
3. A standard APPLICATION FOR APPROVAL OF SALE / LEASE
form, provided by the Association, must be completed by the unit owner or his
representative, and submitted to the Board of Directors, before any proposed sale,
rental, lease or transfer is made. All persons who intend to reside in the unit must be listed in
the approval form.
4. A LEASE AGREEMENT must be used by any owner
leasing or renting out his unit. The lease agreement must provide that the
lessee will abide by all rules and regulations of the Association and that the
lease is subject to the provisions of the Declaration of Condominium and all
Exhibits thereto. In the event of any violation by the tenant, his family,
guests or invitees, of the rules and regulations of the association, or any provision
of the Declaration or the exhibits thereto, such violation shall be deemed a
breach of the lease under which the tenant holds possession of the unit and the
Association shall be deemed a third party beneficiary of such lease for the
purposes of enforcing the rules and regulations and terms and conditions of the
Declaration.
5. Within twenty (20) working days of receipt of the
Application, Lease Purchase Contract, together with other forms deposits, the
Board pending on recommendations of screening company, will approve or disapprove
the lease, sale or transfer. The Board’s failure to act within the specified
twenty (20) working days will constitute assent.
6. Approval for renewal or extension of a Lease must be
obtained from the Board of Directors 60 days in advance of expiration of Lease.
7. No owner may enter into a lease for a term of less than
six (6) months.
8. No lease units are allowed to be subleased.
9. No guests of an owner may use the unit in the owner’s
absence unless written notification is given to the Association before said
guest occupancy. Notification must include the names and permanent addresses of
the occupants, term of stay, the types of vehicles driven and the license plate
numbers, and such other information as the Board may reasonably require.
10. A condominium unit shall not be sold, transferred,
leased or rented except as permitted in the Declaration of Condominium. Any
attempt to sell, rent, or lease a unit without prior approval of the
Association shall be deemed of a breach of the Rules and Regulations, shall be
wholly null and void, and shall confer no title or interest whatsoever upon any
purchaser, tenant or lessee.
11. The Association shall not be obligated to approve or
consent to the sale, transfer, rental or leasing of a unit where assessments
pertaining to such unit are delinquent or where the unit owner is in violation
of the rules and regulations of the Association or the Declaration of
Condominium.
COMMON ELEMENTS
12. Includes all the Condominium property not included
within the single unit. Common elements shall not be obstructed, littered, defaced,
misused or abused in any manner.
13. No structural changes or alterations shall be made to
the common elements, i.e., painting walls, changing the appearance of any
portion of the exterior of the buildings.
14. The unit occupant shall not permit anything to be hung
or displayed in the windows, or placed on the outside of a building, canopy,
shutters, radio, and TV or CB antennas.
ARCHITECTURAL CONTROL
15. The following shall not be altered, modified, changed,
repaired, replaced, decorated, removed, added to, extended, enclosed or painted
without prior written consent of the Association: Common elements, limited
common elements, any outside or exterior portion of the building or condominium
unit, or other exterior areas appurtenant to a condominium unit, including but
not limited to balconies, patios, terraces, parking areas, balcony walls,
ceilings, railings and doors.
16. The following shall not be installed, erected,
attached to, constructed, exhibited or displayed on the common elements, limited
common elements, or on any outside or exterior portion of the building, condominium
unit, or other exterior areas appurtenant to a condominium unit: Awnings, patio
cover, screens, shades, fences, gutters, canopies, window guards, jalousies,
enclosures, shutters, storm or hurricane shutters, light reflective material,
radio or television or citizen band radio broadcasting or receiving devices,
aerials or antennas, landscaping features, ventilators, fans, air conditioning
or dehumidifying devices, wiring, lighting, curbs, sidewalks, brick title
Chattahoochee, concrete slabs, decorative or security bars or gates.
17. The following shall not be hung, exhibited, displayed
painted, inscribed or affixed in, on or upon the interior or exterior of a unit, including windows and/or
sliding glass doors, in such a manner as to be visible from outside of the
unit, without prior written consent of the Association: Sings, notices,
advertisements, decorations, laundry, garments, towels, solar film or other
objects, except for draperies, blinds, shades or other suitable window
coverings.
BURGLAR ALARM
18. Installation of burglar alarm system may be permitted
with prior written consent of the Board of Directors, providing the exterior
portion of the system blends with the architectural design and décor of the community,
and the installation of alarm boxes and/or horns is an inconspicuous as
possible.
19. La
Arboleda Village C.A. Board must
be advised of the name and phone number(s) of a local person will be available
to turn the alarm off should provide the same information to the office.
20. In the event no local contact person or number is
available, the Board will make whatever
arrangements necessary in order to silence the alarm, at the unit or on the
cars (cars could be towed at vehicle owner’s expense).
SWIMMING POOL
21. All persons using the Swimming pool will do so at
their own risk.
22. The pool is for the exclusive use residents (owners/
renters) of LA ARBOLEDA VILLAGE CONDOMINIUM and their authorized guests.
23. No children under the age of 12 years are not allowed
in the swimming pool or pool area if not accompanied by an adult at all times.
24. Parents are directly responsible for the behavior of
their children within the pool recreation area
throughout all the condominium area.
25. All guests, other than those properly registered
guests who are residing in a unit in the absence of the owner, must be
accompanied by the owner or tenant.
26. Proper swimming attire is required in pool. No cutoffs
or shorts are allowed for swimming. No babies in diapers are allowed in the
pool.
27. No running, pushing, horse play or non‐conventional
behavior is allowed in the pool and recreation area.
28. No bicycles, skates or skateboards are permitted in
the pool.
29. Food, Drinks, Glass containers, bottles or glass
objects of any kind are strictly prohibited in the Pool Area.
30. Dogs, cats and any other kind of pet are prohibited in
the pool and recreation area.
31. All trash must be disposed of in the proper
receptacles.
32. Life saving equipment is not to be disturbed. This
equipment is for emergency use only.
33. Use of the swimming pool is prohibited between the
hours of 10:00 P.M. and 8:00 A.M. The pool might be closed at any time, at the
discretion of any member of the Board of Directors.
34. Chairs, tables and lounges may not be removed from the
pool area for any purpose.
35. All persons must shower before entering the pool.
36. Music shall not be played at such a level to be
disturbing to other persons at the pool or the residents in their units.
PARKING
37. No parking spaces or guest spaces are to be changed
(i.e. a guest space cannot be converted into a private space, etc.) by others
unless approved by the Board of Director.
38. Every unit has two (2) assigned parking spaces and the
owner, tenant or resident of the unit shall use only the parking spaces
specifically assigned to the unit.
39. Guests are permitted to use only those spaces so
designated.
40. Improperly parked vehicles or vehicles parked in other
than a designated parking space will be automatically towed away at the vehicle owner’s expense.
41. No commercial vehicles, boats, trailers, motor homes,
motorcycles, mopeds or vehicles having more than four (4) wheels touching the
ground are allowed to be parked on the condominium property.
42. Guest spaces are not to be used as a regular parking
space and vehicles are not to be left in a guest space for a period exceeding
48 hours. Violators will be towed at vehicle owner’s expense.
43. No vehicle which cannot operate on its own power or
which has an expired license plate or which has no license plate shall remain
on the condominium premises for more than twenty‐four (24) hours and no repair
of vehicles shall be made on the condominium premises.
44. The parking lot has not been designed as a play area.
REGULATIONS
45. ACCIDENTS: Any accidents that occur on the common
elements that could involve possible claim against the Association and/or its
insurance carrier must be reported to the Board or Directors immediately, so proper reports
can be filled out. The Board can be contacted via email at laarboledavillage@gmail.com.
46. ABSENTEE OWNERS, EMPTY UNITS: All unit owners and other
residents are requested that when going away for a prolonged period of time,
leave a phone number with the board, so they can be reached in
case of an emergency. Also a local contact where a key can be obtained in case
of an emergency i.e. fire, water leak, etc.
47. BAR‐B‐CUES: Dade County Fire Department Ordinance
prohibits the use of any type of barbecue grills on balconies or within twenty
(20) feet of any building. Therefore cooking is not allowed in accordance to
this ordinance.
48. FLAMABLE UNITS: Dade County Fire Department Ordinance
requires that not flammable, combustible, explosive fluid, material substance,
chemical substance, motorcycles, mopeds or any other vehicle containing
gasoline or flammable fluid be kept inside the units.
49. RECREATIONAL FACILITIES: Unit owners are responsible
for any damages caused to the recreation facilities by themselves, their
family, guests, invitees, servants, lessees and persons who are on the premises
because of the unit owner.
50. DOGS: Walk all dogs along grassy area around the
perimeter of the property. All dogs, regardless of size must be on a leash when
walked and should not be allowed to run free around the complex. All pets are to
be kept from pool and recreation area at all times.
(a) No
more than one dog allowed per unit and dog may not be over twenty (20) pounds.
51. PETS: In the event a resident is permitted by the
Association to maintain a pet in a unit, such resident, in addition to such
other Rules and Regulations as may be adopted by the Association will be
subject to the following restrictions:
(a)
The unit owner shall be financially responsible for any personal injury or property
damage caused to any
other unit owner, occupant, guest or employee of the Association or to any
member of the public, by the pet.
(b)
No pet or other animal may be kept by any resident on any part of the
condominium property which constitutes a nuisance, and which unreasonably
interferes with the quiet enjoyment of premises by other residents.
HURRICANE PREPARATION
52. Each unit owner or resident who plans to be absent
from the unit during hurricane season must prepare his or her unit prior to departure
by: (a) removing all furniture, plants and other objects from the terrace and/or
patio area, (b) designating a responsible firm or individual to care for the
unit should the unit suffer hurricane damage, and (c) notifying the Board of Directors of the name, telephone
number of such firm or individual.
53. Hurricane or storm shutters may not be installed
without prior written consent of the Association.
(Shutters can be utilized only during hurricane or its
alert.)
54. Trash and garbage shall be well secured in plastic
bags and deposited in the garbage containers. Under no circumstances shall any
resident allow any rubbish, garbage or trash to accumulate or be left in places other
than the appropriate garbage containers, so that the common areas and limited
common elements shall at all times remain clean and in sanitary condition.
